stop small town court systems from railroading innocent people
My son who is 20 years old and has never been in any kind of trouble is stuck in a nightmare in Marshall NC. His ex girlfriend had him arrested for communicating a threat. Which he did not do. The police came in his home and threw him on the ground. They held him in jail for 48 hours in a straight jacket no less even though he did not resist arrest or anything. He was terrified. They then set his bond at 10,000.00. We bonded him out and she then filed a 50b against him claiming all sorts of things. When he went to criminal court the girlfriend got on the stand and cried and said she could not remember what happened. Instead of dismissing the case as his lawyer requested the judge found him guilty. When there was no evidence against him. We have appealed that verdict. He has went to court 3 times on the 50b and it has been delayed everytime. This past Monday we went again and it was not heard again. Whenhe returned home there was a letter from DSS stated they found him guitly of neglect of her 2 children. He is the one who took care of them always. This conveniently came about in time for the 50b. Her mother hates my son and is friends with the sherriff, district attorney and multiple other government officials in the town of Marshall. They have not let him be heard at all. I thought this was America where you are innocent until proven guilty. Apparently not in Marshall NC. It only matters what the women has to say. We have now exhausted our savings and new allegations come up every day it seems. She simply wants revenge and the court systems are letting her get away with it. I do not know what to do from here. It seems we have no voice.
